Inclusion of tourism and catering sectors in the digital work card system from 11.9.2024.

Issue no. 44485/24 Decision of the Ministry of Labor and Social Security "Amendment of Part A" "Implementation of the Digital Work Card System - Obligation to Register Digital Details related to the hours of employment in the P.S. ERGANI II" of no. 49758/26-5-2022 (B' 2668) of the decision of the Minister of Labor and Social Affairs (Government Gazette 5151, issue B' of 11.9.2024)

With the above Decision, from 11.9.2024 businesses belonging, by main activity (based on KAD) to accommodation services in the tourism sector, as well as businesses belonging by main activity (based on KAD) to the sector of the focusing.

As defined in the same Decision, the administrative sanctions related to the implementation of the YA Digital Work Card System 80016/31-08-2022 (B'4629) for the above branches, are imposed from March 1, 2025.

It is pointed out that all companies - employers that have joined the digital work card mechanism are obliged, from the date of their joining, to have and respectively activate a digital work card system for all their employees with a contract or a dependent work relationship, who are employed with a physical presence at the place of employment of the companies-employers in question, regardless of whether their branches are in incorporated or non-KAD, including employees who are employed in the above companies through lending, subject to the exceptions mentioned below.

For the businesses in question, since the main company-employer ID card in TAXIS is included in the digital work card and multiple activities are performed in the same place, some of which have not yet been included in the digital card, there is now an obligation to apply the mechanism for all of the their employees.

EXCEPTION from the application of the Digital Work Card system exists:

For the entire business, when:
i. The main employer-business card in TAXIS does not belong to the branches that have been included in the Digital Work Card mechanism, even if multiple activities are performed in the same place, some of which have been included in the digital work card mechanism, or there are branches with a card which have been included in the digital job card.
ii. The employer-enterprise is included in the mechanism of the digital labor card, based on the main employer's KAAD in TAXIS, but this KAAD does not produce economic activity (i.e. it is zero), a fact that is proven by the E3 form of the last tax year and the secondary KAAD, the which constitutes the dominant financial business activity, is not included in KAD.
For branches, when the main employer-enterprise ID card in TAXIS is one of those included in Table 1, but these branches belong to branches of economic activity that have not yet been included in the digital work card, and which, due to their specificity , they will join at a later stage.
